O’NEAL BROKERS TERMS OF OCCUPANCY & RESPONSIBILITY AGREEMENT

THIS AGREEMENT is made and entered into by and between O’Neal Brokers, (we or us), whose principal office is located at 1877 N. Lake Blvd. P.O. Box 802, Tahoe City, CA 96145, and you. The Terms of Occupancy are considered part of this Agreement.

 ARRIVAL AND DEPARTURE TIMES:

Rentals begin at 4:00 PM on arrival day and terminate at 10:00 AM on departure day. Late check-outs may be charged an additional fee. Your keys will be in the lock-box located at the front door of your rental property, or under the front doormat. The lockbox code will be provided after your final payment is made.

RENT PAYMENT: RENT, OCCUPANCY TAX, CLEANING FEE & BOOKING FEE: $300.00 DUE UPON BOOKING; UP TO $500 DEPOSIT MAY BE TAKEN.

BALANCE DUE 60 DAYS PRIOR TO ARRIVAL.

CANCELLATION POLICY:

A: If you cancel outside of 60 days your deposit will be debited for a $100.00 cancellation fee. Any pre-paid lodging fees will be refunded. If you have held the property for 6 months or more the full $300 is NOT refundable.

B: If you cancel 60 days or less prior to arrival the full amount of the rent will be forfeited. The tax, cleaning fee and deposit will be refunded less a $100.00 cancellation fee.

C: If the property is rebooked to another party for the same rate and dates, all monies will be refunded less a $100.00 cancellation fee.

D: There is a $100 change fee to move the dates of your reservation or to make any other changes.

E: If for some reason we allow you to move your reservation, it becomes completely non-refundable.

LONG TERM RENTALS:

Any rentals over 31 days are required to sign a lease agreement with our company.  There will be an additional deposit due as well as a $50 processing fee.  Upon the lease signing the deposit, processing fee and half of the rent will be due.  Our normal cancellation policy will NOT apply to these long-term rentals. 

QUIET HOURS:

Please maintain quiet between the hours of 10 pm and 7 am, this means no loud music, noise, bright lights or other.  Please have respect for the neighbors, some of whom live in their property full time.

DAMAGES:

You hereby agree you are accepting responsibility for any and all damages to the property and its contents, including, but not limited to repairs, fines/assessments, excess cleaning, eviction. You further agree that the costs of any repairs or replacements to the said property will be charged to the deposit or credit card provided at the time of booking. If the property has a bear protector you must turn it on when you leave the property for an extended period of time, damages from a bear caused by a renter not turning on the bear protectors will be charged to the renter.

INTERNET:

Internet service can be spotty or out at the time of your stay, this is not the responsibility of Vacation Tahoe and no refunds will be given.

CLEANING:

You have been charged a cleaning fee as part of your reservation. These fees are based on the size of the house and standard times to clean the property as determined by the cleaning contractors. If the cleaning required exceeds what is considered “normal”, you will be charged for the additional cleaning. If you build a fire, please do not clean out the ashes. Hot ashes will be disposed of properly by housekeeping when cooled. Please follow the checkout instructions, there will be an additional $50 fee if not completed.

TRASH:

All Condos and homes have trash receptacles of some kind.  At the condos, dumpsters are located around the properties, you may need to look for them (especially in the winter).  The dumpsters are unlocked during the day. The Villas have a code to get into their dumpsters, this is provided in the rental binder. Homes have bear boxes where you can put the trash.  NEVER leave any trash outside of the dumpster or bear bins, the bears will get into it and make a mess, you will be charged $50-$100 additional for these messes.

PETS:

NO PETS ALLOWED except by previous arrangements for select properties. A fine will be assessed by some Homeowners Associations. You will be charged $500.00 and be given a request to immediately vacate the property for bringing unauthorized pets. SOME OF OUR OWNERS HAVE SEVERE PET ALLERGIES, A PET WILL NOT BE PERMITTED AT THESE PROPERTIES – NO EXCEPTIONS.

FOR PET-FRIENDLY PROPERTIES, there is a $100 pet fee(plus tax).

These rules will apply to all pet-friendly properties:

1.    To observe Placer County Leash Law

2.    To guarantee that the dog will not become a nuisance to the neighbors

3.    To guarantee that the dog will, AT NO TIME, be left alone on the premises (this includes interior and exterior, e.g. decks, etc.)

Should the dog become a nuisance and action is not taken by the tenant to rectify the problem, the owner or his agent shall have the right to cancel the rental agreement.

If your pet sheds excessively there may be a charge for extra vacuuming, blanket laundering, etc.

The tenant assumes full responsibility for any damages to property and/or premises by the pet.

WE ALSO REQUEST THAT YOU CARRY A SHOVEL, SCOOPER OR PLASTIC BAG SO YOU MAY CLEAN UP AFTER YOUR PET.

AUTOMOBILES:

 Most rental properties permit two cars per property. Inquire with the property manager. Additional or improperly parked cars may be towed or fined. During the winter months (Nov. thru April) please do not park any vehicles on the street at rental HOME locations. This is prohibited by Placer County which imposes strict fines for violations.

RECREATIONAL VEHICLES:

Boats and/or trailers, mobile homes, campers, all types of motorcycles, mopeds, and snowmobiles are prohibited from use and/or parking at the condominium developments and houses.

RECREATIONAL KEYS/PASSES:

 A $100.00 to $200.00 fee will be assessed for any and all spa keys, recreation passes, and/or security gate passes that are not returned, lost or stolen.

BUOYS:

The Owner/Broker is not liable for any damages that occur from use of the buoy, use at your own risk.

AMENITIES:

Including but not limited to: Beach Clubs, Pools, Hot Tubs, Tennis Courts, Playgrounds, Etc…

Some amenities may not be available at the time of your stay. There will be no refunds.  If you are renting a property with access to the HOA amenities, please note that only the guests staying at the property are allowed access to those amenities, there will be a $1000 per day fine if you bring in outside guests. Please be respectful of the rules and other people. Some amenities are seasonal, we do not guarantee access.

SLEEPING CAPACITIES:

Individual properties sleep varying amounts of persons. No more persons than for which there are bona fide beds shall occupy a property. If you exceed the occupancy you will be charged a fine to be determined by management. Per Placer County STR Ordinance fines may be up to $1000

CREDITS:

Inconveniences over which we have no control and which do not warrant any refunds: breakdown of appliances or entertainment/recreational devices; internet/wireless connections; power, gas, cable outages; adverse road/weather conditions (does not include road closures exceeding 6 hours); construction taking place in the area; a property that is not decorated to suit one’s individual taste.

FIREWOOD:

Firewood is not provided in most rental properties. You can purchase boxes and bundles of wood from the local grocery stores, Save Mart and Safeway or Swigard’s True Value Hardware. ABSOLUTELY NO CHARCOAL BBQING, OUTDOOR FIRE PITS OR ANY OTHER OPEN FLAME ALLOWED OUTSIDE.

SPA DISCLOSURE:

If the property you have reserved has a hot tub on the premises, please be advised that hot tubs are a wonderful, pleasurable amenity if used correctly. They are, however, a very high maintenance item subject to a degree of downtime. Should the hot tub at the residence or development you’ve rented not be available during your stay, $25.00 per night will be the maximum basis for any rent adjustment. Does not apply to Covid or seasonal closures. Please do not add soaps, perfumes, oils, etc. to the spa as it could incur an extra cleaning charge.

RENTER IS RESPONSIBLE:

A. Renter is responsible to report, upon arrival, any damages noted in the property. Said report to be made by phone 530-583-3723  during business hours, 9:00 am – 4:30 pm 7 days a week (except major holidays). If it’s after hours please feel free to leave a message.

B. Renter is responsible for any loss or damage to the contents of the property, including but not limited to furniture and furnishings. Owner and agent are not responsible for any loss or damage to property left on premises by the renter.

LOST & FOUND:

We will try to locate any of your lost items as soon as possible and send them to you. Your credit card on file will be charged for the shipping fee and a $25.00 retrieval fee. Management is not responsible for any items left behind by renters or guests.

CONSTRUCTION NEAR YOUR RENTAL PROPERTY:

The Tahoe area is a continuously growing community. There are many construction projects underway in our area at any given time. We cannot guarantee that you will not be affected by construction noise and/or traffic.

SMOKE & FIRE: It is at the company’s discretion to refund or re-schedule due to smoke or fires in the area.

BEAR WIRES or MATS: Renter takes full responsibility for themselves, guests, children and pets.  Owner and rental agency are not liable for electric shock.

FINES UP TO $1000 MAY BE IMPOSED FOR ANY VIOLATION OF THIS AGREEMENT
